JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-07-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. At the very outset, it is pointed out on behalf of the petitioners that petitioner no. 1 namely Sk Dhamu @ Firoj Alam has already been arrested and accordingly, his prayer for anticipatory bail stands dismissed being infructuous. Petitioner no.

apprehends his arrest in connection with Balthar P.S. Case No. 04 of 2015 registered for the offences punishable under Sections 341, 323, 324, 379 and 307 of the Indian Penal Code.

So far as, prayer for anticipatory bail of petitioner no. 2 namely Sk. Lalu @ Jabed Alam is concerned, taking note of allegation levelled against him as well as this aspect of the

No.22092 of 2015 (2) dt.06-07-2015 matter that one counter case for the offence under Section 302 of the Indian Penal Code and other minor sections of the Indian Penal Code has been lodged against the informant of this case and others, let the petitioner no. 2, namely Sk. Lalu @ Jabed Alam, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sri Jitesh Kumar, J.M., Ist Class, Bettiah, West Champaran in connection with Balathar P.S. Case No. 04 of 2015, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
