The petitioner apprehends her arrest in Pawana P.S. Case No.53 of 2019 registered under Sections 302, 120(B) and 34 of the Indian Penal Code.
The informant (grandfather of the deceased) alleged that his grandson came to his house after irrigating the field but immediately thereafter he left the house after receiving a mobile call but thereafter his grandson did not return in the night. In the next morning, a search was made and the dead body of the grandson of the informant was found floating in a river. The informant alleged that his grandson had love affairs with Rubi Kumari (daughter of Bhada Singh) and that is why Manti Devi wife of Ramesh Singh, Bhada Singh and wife of Bhada Singh killed the grandson of the informant and threw his dead body in

Learned counsel for the petitioner submits that the petitioner is the mother of Rubi Kumari and the wife of Bhada Singh. There is no material to show that the petitioner killed the deceased. Even during the course of investigation, it has come that Manti Devi called the deceased and thereafter the deceased became traceless. Manti Devi is not the family member of the deceased. Even the Dog Squad was pressed into service but no clue was found. There is absolutely no evidence against the petitioner.
Learned A.P.P., however, opposed the prayer for anticipatory bail.
From perusal of the case-diary, it appears that the deceased had love affairs with the daughter of the petitioner. Manti Devi is a close relation of the petitioner and her husband. From perusal of para 17 of the case-diary, it appears that the last call was made from Mobile No.7367819325 on 08.09.2019. They talked with each other for 363 seconds. Several calls were made. Mobile No.9102634589 belongs to Manti Devi wife of Ramesh Singh. It transpires that it was Manti Devi (a close relation of the petitioner), who called the deceased on 08.09.2019 and thereafter the deceased became traceless and on
Patna High Court CR. MISC. No.36781 of 2020(4) dt.12-07-2021 3/3 the next morning his dead body was found floating in a river. The case relates to honour killing only because the deceased had love affairs with the daughter of the petitioner. The offence is very serious in nature.
Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
