This is the second attempt by the petitioner to seek regular bail in a case arising from Bathnaha in P.S. Case No.23 of 2015 registered for offences punishable under sections-399 and 402/115 of Indian Penal Code and section-25(1-b)a/26/35 of Arms Act.

The petitioner had earlier moved in Criminal Miscellaneous No.57895 of 2015 and it is considering the nature of accusation that the prayer was refused at that stage. The petitioner has renewed his prayer to submit that apart from the fact that he was not apprehended from the spot, his name has been taken by a co-accused and he has remained in custody for about 11 months.

Having heard learned counsel for the parties and

Patna High Court Cr.Misc. No.34259 of 2016 (2) dt.24-08-2016 considering the circumstances, let the petitioner namely, Vijay Ram be released on bail on furnishing bail bond of rupees ten thousand (Rs. 10,000/-) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in connection with Bathnaha P.S. Case No. 23 of 2015, subject to the condition that he would ensure his appearance before the Court below on each and every date fixed in the case and his failure to do so on two consecutive dates without reasonable cause shown to the satisfaction of the court concerned, the court below would be entitled to cancel his bail bonds and take him into custody.
