JUSTICE BIRENDRA KUMAR ORAL ORDER 11-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 302/201/34 of the Indian Penal Code.

The petitioner is mother-in-law of the victim lady. She died after twelve years of her marriage with co-accused. There is general and omnibus allegation of demand of dowry and torture for the same.

Submission is that presumption of dowry death is not there and there is no witness of the occurrence of murder as alleged.

Considering the aforesaid facts, let petitioner,

Patna High Court Cr.Misc. No.17287 of 2017 (2) dt.11-04-2017 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Gaya/Successor Court, in connection with Atri P.S. Case No.249 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
