JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-25(i-A), 25(i-B), 26/35 of the Arms Act. One loaded country-made Katta and 18 live cartridges, kept in polythene are said to have been recovered from conscious possession of the petitioner whereas; one Katta, magazine and other apparatus, which are used in manufacturing of fire-arms, were recovered from house of the petitioner. Submission on behalf of petitioner is that according to prosecution case itself, husband of the petitioner was engaged in manufacturing and selling fire-arms and cartridges and, as a matter of fact, the police implicated the petitioner in this false case when

Petitioner does not have any criminal antecedent and is languishing in jail custody since 05-02-2016 and, as per submission, advanced on behalf of the petitioner, her husband has already surrendered before the court below.'

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Gogri P.S. Case No. 17 of 2016 to the satisfaction of Sri Brajesh Kumar, learned Judicial Magistrate-Ist Class, Khagaria.
