The petitioner seeks bail in connection with Special Case No. 403 of 2018 registered Section 30(a) of Bihar Prohibition and Excise Act-2016.

150 lts. of foreign liquor is said to have been recovered from car of the petitioner and he was apprehended while two other persons, namely, Sunil Mandal and Rupesh Kumar Choudhary managed to escape.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has been falsely implicated in this case at the instance of his co-sharer

Patna High Court Cr.Misc. No.27631 of 2018(3) dt.28-06-2018 2/2 with whom land dispute is pending by the personnel of Excise Department by planting the aforesaid recovery from his car while he was proceeding to D.T.O. office for registration of newly purchased car. Though, several cases have been lodged against the petitioner either by the aforesaid co-sharer or at his instance, but the petitioner is on bail in the aforesaid cases. He has been languishing in custody since 23.03.2018. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Araria in connection with Special Case No. 403 of 2018.
