The petitioner apprehends his arrest in connection with Ekma P.S. Case No.31 of 2014 registered under Sections 304B, 328, 201 and 34 of the Indian Penal Code. The informant alleged that the petitioner (husband) and his family members were torturing his daughter and lastly, they have killed her for demand of motorcycle It has been submitted on behalf of the petitioner that the present case has been instituted due to mistake of fact. The attention of the court has been drawn to Annexure-2 which is a petition filed on behalf of the informant in the court below stating that the present case has been instituted due to mistake of fact. It is further submitted that the deceased had died due to snake bite. It is also pointed out that there is no external injury on the body of the deceased, which is evident from the Post Mortem Report. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

No.21795 of 2015 (3) dt.09-07-2015 2/2 Considering the facts and circumstances, the petitioner, named above, in the event of his arrest/surrender in the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in connection with Ekma P.S.Case No.31 of 2014, subject to condition as laid down under section 438(2l of the Cr.P.C.
