Petitioner seeks bail in Jahanabad P.S. Case No. 546 of 2017 registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code.
Informant is the mother of the deceased, who in her written complaint has said that the marriage of her daughter was solemnized with the petitioner about three years back and thereafter she was subjected to torture for non fulfillment of demand of dowry. It has been further alleged that the petitioner and his family members have killed her daughter by strangulation.
It has been submitted on behalf of the petitioner that
Patna High Court Cr.Misc. No.23023 of 2018(5) dt.28-08-2018 2/2 no external or internal injury has been found on the person of the deceased and the allegation against the petitioner of torture for non fulfillment of demand of dowry is false. In the Post Mortem Report, it has been opined by the Doctor that the death is due to suicide by hanging. Petitioner has got no criminal antecedent and is in custody since 12.10.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Sub-judge-I-cumACJM, Jehanabad, in connection with Jahanabad P.S. Case No. 546 of 2017.
