JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Nauhatta P.S. Case No. 122 of 2009 registered for the offence punishable under Section 392 of the Indian Penal Code. Petitioner is not named in the first information report but in course of investigation, the name of this petitioner surfaced in this case in confessional statement of co-accused, from whose house the stolen motorcycle was recovered.

It is submitted on behalf of the petitioner that confessional statement of co-accused does not have any evidentiary value but, in my view, the confessional statement of co-accused is relevant for the purpose of investigation and the

Considering the aforesaid facts and circumstances as well as submissions of the parties and also keeping in mind the criminal antecedent of the petitioner, I am not inclined to grant the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Nauhatta P.S. Case No. 122 of 2009 pending in the court of Sri Mukesh Kumar, Judicial Magistrate, Saharsa stands rejected. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
