The petitioner is accused in connection with Mushahari P.S. Case No. 171 of 2016, registered under Sections 272 and 273 of the Indian Penal Code and Sections 30(a), 36 and 38 of the Excise Act.

The accusation is that in course of patrolling duty, two persons were seen escorting on motorcycle to the pick up van and on seeing the Police party, they started fleeing out of them one person was apprehended by the Police party, who disclosed his name as Mahadeo Bhagat (Petitioner). On search of the Pick up van, 17 cartons, each containing 12 bottle of 750 Ml India made foreign liquor, 17 cartons each containing 24 bottle of 375 ML, 12 carton each containing 48 bottle of 180 ML, 04

Patna High Court Cr.Misc. No.14207 of 2017 (2) dt.07-04-2017 2/2 cartons each containing 12 bottles of 750 ML and 02 carton each containing 12 bottle of 750 ML India made foreign liquor recovered. The petitioner also disclosed his four associates, who succeeded to flee away.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent is in custody since 12.12.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Judge-III-cum-ACJM, Muzaffarpur in connection with Mushahari P.S.
