JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-06-2017 The petitioner seeks regular bail in connection with Mahishi P.S. Case No. 08/2015, registered for offences punishable under Sections 147, 148, 149, 341, 307, 324 of Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is of firing on the brother of the informant causing fire arm injury to him. It has been submitted on behalf of the petitioner that now the petitioner has remained in custody for about two years and has sufficiently been punished for the said offence. Further uptil now the case has not been committed to the court of sessions. Heard learned A.P.P. also.

Having heard both sides, in view of the fact that there is direct allegation against the petitioner of firing on the brother of

Patna High Court Cr.Misc. No.19990 of 2017 (3) dt.19-06-2017 2/2 the informant causing him grievous injury, as such, I am not inclined to release the petitioner on bail, his application for grant of regular bail is, accordingly, rejected.

However, the trial court is directed to expedite the trial and try to conclude it as soon as possible preferably within a period of nine months from today.

At the same time Superintendent of Police, Saharsa is directed to ensure the attendance of witnesses in the court on the date fixed so that the trial can be concluded expeditiously. (Vinod Kumar Sinha, J) sunil/- U T
