The petitioner has renewed his prayer for bail in a case registered under sections 302, 201 and 34 of the Indian Penal Code.

As per the prosecution case, the petitioner along with four others are said to have assaulted the father of the informant leading to his death.

It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 2.3.2022(Annexure-1) passed in Cr. Misc. no. 39844 of 2021 giving liberty to the petitioner to renew his prayer for bail after framing of charge. The petitioner is in custody since 16.7.2020. Referring to the order as contained in Annexure-3 it

Patna High Court CR. MISC. No.42309 of 2022(2) dt.14-09-2022 2/2 is submitted that charge has been framed against the petitioner in the learned trial Court on 20.1.2021 and the petitioner is in custody since 16.7.2020. He undertakes to cooperate in the trial. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner, the petitioner having remained in custody since 16.7.2020, the liberty granted to the petitioner in the earlier order of rejection dated 2.3.2022 and charge having been framed against him in the learned trial Court, the petitioner is directed to be enlarged on bail in connection with S.Tr. no. 463 of 2020 (arising out of Panapur P.S. Case no. 101 of 2020) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-V, Saran at Chapra.
