JUSTICE RAKESH KUMAR ORAL ORDER 16-08-2016 Heard Sri Y.C.Verma, learned Senior Counsel, who was assisted by Smt. Priyanka Singh, learned counsel for the petitioners and learned Addl. Public Prosecutor. Two petitioners, who are in custody since 04.05.2016 in connection with Kundwa Chainpur P.S. Case No.36/2016 registered for the offence under Sections 272, 273 of the Indian Penal Code and Section 47A of the Excise Act, 2016, have prayed for grant of bail.
Learned Addl. Public Prosecutor, opposing the prayer of the petitioners, submits that from the possession of the petitioners, huge quantity of liquor was recovered. He further submits that they were apprehended while they were carrying
Patna High Court Cr.Misc. No.31890 of 2016 (2) dt.16-08-2016 2/2 liquor from Nepal.
Besides hearing learned counsel for the parties, I have also perused the material on record.
Keeping in view the nature of accusation, let the petitioners, namely, (i) Md. Eqbal and (ii) Lal Babu Mukhia be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sikrahana at Dhaka in connection with Kunda Chainpur P.S. Case No.36/2016.
