Petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

Petitioner is driver of an Auto Rickshaw, from which country made liquor was recovered hidden behind the back seat of the vehicle. Petitioner has got criminal antecedent of identical nature.

Considering the entire facts, let the petitioner, above named, be released on bail if the trial is not concluded within six months from the date of framing of the charges on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand)

Patna High Court CR. MISC. No.35979 of 2019(2) dt.04-06-2019 2/2 with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Special Case No. 4257 of 2019, arising out of Punpun Police Station Case No.123 of 2019, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
