2. The petitioner apprehend his arrest in a case registered for the offence punishable under Sections 341, 323, 435, 436, 504, 447/34 of the Indian Penal Code.

As per the F.I.R., it is alleged that co-accused Brijkishore Sahani threatened the informant and thereafter on 27.01.2024, all the accused persons including the petitioner set fire in the motorcycle of the informant which was kept in the hutment due to which informant suffered loss of Rs. 7 Lakhs. 4.

Learned counsel appearing for the petitioner submit that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The name of the petitioner sprung up in

Patna High Court CR. MISC. No.41881 of 2024(2) dt.16-07-2024 2/2 this case due to enmity of Panchayat election. The petitioner has no concern with the co-accused Brijkishore Sahani. The petitioner bears fair antecedent.

Learned A.P.P. for the State has opposed the prayer for grant of anticipatory bail to the petitioner. 6.

Considering the aforesaid facts of the case and also considering the clean antecedent of the petitioner, this anticipatory bail is allowed, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of J.M. 1st Class, Sikrahana at Dhaka in connection with Chiraiya P.S. Case No. 33/2024 subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
