JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Section 25(1-b)a of the Arms Act.

Admittedly, neither the petitioner was caught on the spot nor anything recovered from his conscious possession and so far as recovery of country made rifle and motorcycle are concerned, the same are said to have recovered near the hut of the petitioner and not from inside the hut.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of the fact that the petitioner does not have any criminal antecedent, let the

No.28810 of 2016 (2) dt.25-07-2016 2/2 petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Nabinagar P.S. Case No. 06 of 2016.
