JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-05-2018 Earlier prayer of bail of the appellant was dismissed by this Court vide order dated 17.7.2017 passed in Cr.Appeal(SJ) No. 1253 of 2017 with direction to learned trial court to conclude the trial within a period of six months and appellant was given liberty to renew his prayer for bail if trial is not concluded within the said period. Allegation is of not providing amount of Government Scheme by appellant and abusing them, when they demanded the same.

Submission of learned counsel for the appellant is that not a single witness has been examined till date and he is in custody since 11.12.2016.

Having heard both sides and in the facts and

Patna High Court CR. APP (SJ) No.1186 of 2018 (4) dt.09-05-2018 2/2 circumstances, the appeal is allowed and set aside the order dated 28.2.2017. Let the appellant, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I, Hilsa (Nalanda), in connection with Islampur P.S. Case No. 166 of 2007, subject to the conditions that one of the bailors shall be a local person having sufficient immovable properties within the jurisdiction of court concerned and further appellant has to co-operate in trial and appear before the court below as and when required, otherwise his bail bond shall be cancelled.
