1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The learned counsel for the petitioner at the outset seeks permission to withdraw the anticipatory bail application with respect to petitioner no.1 Girdhari Yadav.
3. Permission is accorded.
4. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 147, 148, 323, 324, 504, 506, 354, 448, 427, 307 and 379 of the Indian Penal Code.
5. Learned counsel for the petitioner submits that petitioner no.2 is a person with clean antecedent and has been

It is also submitted that the allegation of assault is not specific against the petitioner no.2. It is further submitted that the informant alleges that the accused persons including the petitioner assaulted his three sons with an intention to kill but then the allegation is not specific and petitioner is not a criminal.
6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
7. Considering the submissions made by the learned counsel for the petitioner, the petitioner no.2, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Ballia P.S. Case No.71/2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) amit/- U T
