====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 09-05-2018 Heard Sri Bhavesh Kumar, learned counsel for the petitioner and Sri Tapeshwar Sharma, learned Addl. Public Prosecutor.

This is second attempt for grant of bail on behalf of the petitioner. Earlier, by order dated 25.04.2018, a report from the court below was called for regarding stage of the case, which has been received and kept at Flag-A. The report, contained in letter no.138 dated 01.05.2018, sent under the signature of the A.C.J.M.IX, Gaya indicates that during trial out of 12 witnesses, five prosecution witnesses have already been examined. Meaning thereby that the trial is continuing. Accordingly, there is no reason to review my earlier order. The prayer for bail again stands rejected. While rejecting the prayer for bail , considering the

Patna High Court Cr.Misc. No.24139 of 2018(3) dt.09-05-2018 2/2 period of custody, it is desirable to direct that the prosecution shall render full cooperation to the trial court for its early disposal. It goes without saying that the concerned Superintendent of Police shall ensure production of witnesses , as and when required by the trial court.

Let a copy of this order be sent to the concerned Superintendent of Police for its compliance.
