Petitioner, already in custody, seeks bail in connection with Excise Case No.345 of 2016, registered under Section 30(2) of the Bihar Excise Act, 2016.

Allegation in brief is that excise officials recovered 9 litres of illicit Mahua liquor from petitioner's motorcycle. Learned counsel appearing on behalf of the petitioner submits that very small quantity is alleged to have been recovered. The petitioner has got no criminal antecedent and has been in custody since 15.12.2016.

Having considered the said facts and circumstances, petitioner Niraj Rai is directed to be released on bail on furnishing

Patna High Court Cr.Misc. No.11470 of 2017 (2) dt.17-03-2017 2 / 2 bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Excise Case No.345 of 2016.
