JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Dhamdaha P.S. Case No. 128/2014, registered under Sections 406, 420, 467, 468, 471, 120(B) and 295A of the Indian Penal Code. The accusation is that one Girija Devi used to get deposited money with assurance that the money will be just doubled in a month. Twenty two persons, named in the FIR including the petitioner, were also in her group insisting the people to deposit the money. When the informant & others asked to return the money, then they refused to return the money. Submission is that the petitioner has falsely been implicated in this case and similarly situated co-accused, Girija

Patna High Court Cr.Misc. No.17659 of 2017 (3) dt.04-05-2017 Devi, has already been granted privilege of bail vide order dated 28.08.2015 passed in Criminal Misc. No. 38327/2015 and the petitioner is in custody since 07.02.2017.

Having regard to the facts and the circumstances of the case, the petitioner Bhairav Thakur, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Dhamdaha P.S.
