This application is for grant of bail in connection with Magadh University P.S.Case No.101 of 2016 for the offence under Sections 272, 273/34 and 387/34 of the Indian Penal Code and 30(A) & 30(2) of the Bihar Amended Excise Act, 2016. It is submitted on behalf of the petitioner that he has no way concern with the alleged seized articles and it has come during the course of investigation of the case that the vehicle belongs to the other persona. The petitioner is in custody since 06.12.2016. Heard learned A.P.P. also, who has opposed the prayer for bail, stating that there is recovery of huge quantity of foreign liquor from the vehicle, which was being driven by the petitioner. Having heard both sides. Considering the huge quantity of

No.9044 of 2017 (2) dt.28-02-2017 liquor recovered from the vehicle, which was being driven by the petitioner, I am not inclined to grant bail to the petitioner at this stage, however, the petitioner may renew his prayer for bail in the learned court below, after completion of six months of the period his custody.
With the aforesaid observation, this application is dismissed.
