This is 2nd attempt for grant of anticipatory bail on behalf of the petitioner who apprehends his arrest in connection with Imamganj P.S. Case No. 132 of 2018 registered for the offence under Sections 324, 307, 34, 302 of the I.P.C. inasmuch as the anticipatory bail application of the petitioner was earlier rejected by this court vide order dated 17.09.2019 passed in Cr. Misc. No. 34933 of 2019.

Learned counsel for the petitioner tried to re-argue the case by way of 2nd anticipatory bail application and submits that during the course of investigation it has come to light that one of the co-accused / Anil Pandey was not present at the place of occurrence which creates doubt on the entire prosecution story. Having heard learned counsel for the parties and taking into consideration the fact that the anticipatory bail
