JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-05-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier, the prayer for bail of the petitioner was rejected by this Court taking note of allegation leveled against the petitioner but submission on behalf of the petitioner is that the doctor, who conducted the post mortem examination on the corpse of the deceased, has been examined in this case as PW-2 and the aforesaid doctor found the injuries caused by sharp cutting weapon but all the aforesaid injuries were found on non vital part of the dead body of the deceased and the aforesaid doctor admitted in his cross-examination that the aforesaid injuries were not sufficient to cause death of the deceased. Moreover, no injury was found on the neck of the deceased.

Patna High Court Cr.Misc. No.10718 of 2017 (3) dt.03-05-2017 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Session Judge 1st, Nawada in connection with Session Trial no. 15 of 2015 arising out of Rajauli P.S.Case No. 172 of 2014.
