2. The petitioner seeks bail in connection with Muffasil P.S. (Aurangabad) Case No. 121 of 2025 registered for the offence punishable under Sections 303(2), 317(2) and 3(5) of the Bharatiya Nyaya Sanhita.

3. As per the prosecution case, the petitioner is alleged to be involved in illegal sand mining.

4. Learned counsel for the petitioner submits that the petitioner has been implicated in this case merely on the basis of suspicion. The petitioner is not involved in any illegal

Patna High Court CR. MISC. No.41266 of 2025(2) dt.09-07-2025 2/2 activity and has been implicated in the present case because of his prior criminal antecedent and village politics. The petitioner is in custody since 15.04.2025.

5. Learned counsel for the Mining Department has opposed the case vehemently and has submitted that the petitioner has cause heavy loss to the estate exchequer.

6. Considering the allegation and the period of custody, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad/ concerned Court in connection with Muffasil P.S. (Aurangabad) Case No. 121 of 2025.
