JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-05-2017 The appellants seeks regular bail in connection with Bachhwara P.S. Case No. 109 of 2016, registered for offences punishable under Sections 363A. 364A, 323, 372 of Indian Penal Code and Section 3(i)(x) of the SC/ST Act.

Allegation against the appellant that he along with other accused persons abducted the daughter of the informant and taken her to Punjab and later on she was recovered. It has been submitted on behalf of the appellant that in this case now the girl has been recovered and she in her statement recorded under Section 164 Cr.P.C. has stated that the appellant has done no wrong with her and further she has not made any allegation against the appellant and he has been in judicial custody since 28.10.2016.

Patna High Court CR. APP (SJ) No.710 of 2017 (4) dt.18-05-2017 2/2 Heard learned Special Public Prosecutor also. Having heard both sides, considering the aforementioned facts and circumstances, the period of custody and also the girl in her statement recorded under Section 164 Cr.P.C. has not alleged anything against the appellant, as such, this appeal is allowed, the appellant, above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, SC/ST, Begusarai, in connection with Bachhwara P.S. Case No. 109 of 2016, after setting aside the order dated 02.12.2016, passed by the learned Special Judge, SC/ST, Begusarai.
