Earlier the petitioner was granted privilege fo regular bail by this Court, vide order dated 20.9.2017 passed in Cr. Misc. No.43809 of 2017, however, his bail bond has been cancelled because he had not appeared on the day of pronouncement of the judgment and filed a petition under Section 317 of Cr.P.C. Submission of the learned counsel for the petitioner is that there is only one day of misuse of bail. Heard learned A.P.P. also.

From perusal of the impugned order, it appears that when the case was posted for judgment, the accused person has not appeared and due to that the judgment could not be delivered

Patna High Court Cr.Misc. No.27793 of 2018 (3) dt.20-06-2018 2/2 and the petitioner has appeared now but the other accused persons are not appearing.

Having heard both sides and considering the conduct of the petitioner, I am not inclined to grant bail to the petitioner, hence, this application is rejected.
