This is an application for bail in connection with Raghopur P.S.Case No. 4 of 2015 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

It has been submitted on behalf of the petitioner that though the petitioner is alleged to have fired along with other accused persons on the deceased but the petitioner was not present at the time of occurrence and he is in custody in connection with other case but the aforesaid fact has not been verified by the I.O. Heard learned APP and learned counsel for the informant also, who have opposed the prayer for bail stating that there is direct allegation against the petitioner of firing.

Patna High Court Cr.Misc. No.10291 of 2017 (4) dt.04-04-2017 2/2 Having heard both sides and considering the direct allegation against the petitioner of firing at the deceased, I am not inclined to grant bail to the petitioner.

This application is dismissed.
