JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-07-2018 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Madhepura PS case no. 49 of 2018 instituted for the offence punishable under Section 306 of Indian Penal Code. The allegation is that the petitioner herein, who is the husband of the deceased, had engaged in adultery resulting in his wife committed suicide.

The learned counsel for the petitioner submits that the petitioner has got no role to play in the alleged incident since both the husband and the wife were staying separately for some time. It is further submitted that the present case is a clear cut case of suicide and the petitioner has got no role to play so as to make

Patna High Court Cr.Misc. No.25384 of 2018 (3) dt.06-07-2018 2/2 out a case under Section 306 of Indian Penal Code. The petitioner is said to be languishing in custody since 28.01.2018 and he has a clean antecedent.

Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Madhepura in connection with Madhepura PS case no. 49 of 2018.
