The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 201, 120B and 34 of the Indian Penal Code.

As per the prosecution case, the son of the informant had gone to his maternal uncle's place. Information was received that he has disappeared and subsequently his dead body was recovered. It appears that unknown person had killed him.

It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown. The name of the petitioner transpired in course of investigation in the confessional statement of the coaccused made before the police. No incriminating material has transpired to connect the

Patna High Court CR. MISC. No.49729 of 2021(3) dt.08-03-2022 2/2 petitioner with the alleged crime. There is no eye witness to the occurrence. The petitioner is in custody since 18.5.2021 and investigation in the case has been completed. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the material that has transpired in course of investigation together with the petitioner having remained in custody for 9 months, the Court directs the petitioner to be enlarged on bail in connection with Buxar (Ind.) P.S. Case no. 82 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Buxar.
