JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. One mini gun factory was unearthed and several unfinished and other apparatus, which are used in manufacturing firearms, were recovered. Petitioner and some others were caught on the spot.

No doubt, petitioner is in jail custody since 19.01.2016 but taking note of the aforesaid facts as well as this aspect of the matter that earlier, he was made accused in a case which had been registered for the offences under the Arms Act, I am not inclined to release the petitioner on bail and, hence, his prayer for bail in connection with Khagaria ( Muffasil) P.S.Case No. 36 of 2016 (G.R. No.139 of 2016), pending in the court of

Patna High Court Cr.Misc. No.30692 of 2016 (2) dt.08-08-2016 2/2 Sub-Divisional Judicial Magistrate, Khagaria stands rejected. However, the learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably, within four months from the date of receipt/ production of copy of this order, failing which petitioner may renew his prayer for bail before the learned trial court itself.
