Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 307, 324, 506 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation against the petitioner is of causing fire arm injury by country made pistol on the shoulder of the informant. The injury report brought on record as Annexure-4 reflects that injury was not caused by fire arm. It is submitted by learned counsel for the informant that ultimately the injury was found to be caused by fire arm.

Considering the materials on record, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today,

Patna High Court Cr.Misc. No.21981 of 2015 (2) dt.26-06-2015 2/2 be released on provisional anticipatory bail for three months on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Simari P.S. Case No. 218 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

Let learned Court below confirm the provisional bail of the petitioner, if final injury report does not suggest that injury was caused by fire arm. But, if final injury report suggests otherwise then petitioner will surrender and pray for regular bail.
