JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-08-2019 This application, for grant of anticipatory bail, arises out of Madhubani Town P.S. Case No. 264 of 2013 disclosing offences under Sections 341, 323, 384, 379, 504 and 34 of the Indian Penal Code.
Allegation against the petitioner and other accused persons is of demand of rangdari from the informant. Further allegation is that co-accused Faijullah snatched Rs. 7,000/- from the informant and when one Amatullah came to save the informant, petitioner alleged to have snatched his chain. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and no such occurrence as alleged in the F.I.R. has ever taken place. Further submission is that co-accused Faijullah has already been granted

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani, in connection with Madhubani Town P.S. Case No. 264 of 2013, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
