The petitioner seeks bail in Kankarbagh P.S. Case No. 458 of 2021, registered for the offence punishable under Sections 420, 188, 120(B) of the Indian Penal Code, section 52/53 of the Disaster Management Act, section 3 of the Epidemic Disaster Management Act, section 7 of the Essential Commodities Act and section 28/36 of the Drugs and Cosmetics Act.

As per the prosecution case, on secret information that some miscreants are illegally selling life saving Remdesivir injection on exorbitant price a raid was conducted and this petitioner along with two accused persons were apprehended by the police while they were selling 03 bottles of Remdesivir

Patna High Court CR. MISC. No.51083 of 2021(2) dt.29-11-2021 2/2 Injection and from their possession cash of Rs. 1,20,000/- has been recovered.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case merely on suspicion. No incriminating article or injection has been recovered from conscious possession of this petitioner. Petitioner claims clean antecedent and he is in custody since 08.05.2021.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in connection with Kankarbagh P.S. Case No. 458 of 2021.
