JUSTICE SUDHIR SINGH ORAL ORDER 17-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Section 307 of the I.P.C. and Sections 25(1-b)a, 26 and 27 of the Arms Act.

The allegation against the petitioner is of firing on the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.3.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. None is said to have been injured in course of the occurrence. One country made pistol along with five cartridges are said to have been recovered from the possession of the petitioner. There is no compliance of Section

Patna High Court Cr.Misc. No.33720 of 2016 (3) dt.17-10-2016 100 of Cr.P.C. There is admitted land dispute between the parties. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Gaya in connection with Rampur P.S. case No.94 of 2016.
