The petitioner is seeking anticipatory bail in connection with Jehanabad P.S. Case No. 81/2019 registered under Sections 34, 323, 354, 307, 504/341 of the Indian Penal Code.

The case of the prosecution is that one Mazahabi Khatoon who happened to be Bhabhi of the petitioner made allegations that the petitioner besides co-accused came to the door of the informant and demanded some cash. Her husband showed his inability to pay the said amount whereupon the accused persons assaulted with Danda to the informant and her husband with an intention to kill who sustained head injuries. It

No.36525 of 2019(2) dt.12-06-2019 2/2 is submitted that petitioner and informant are Dewar and Bhabhi respectively having some dispute over the property and both of them have suffered simple injuries in course of assault. Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.

Considering the facts and circumstances of the case wherein the petitioner and informant are Dewar and Bhabhi respectively having some dispute over the property and both of them have suffered simple injuries in course of assault, in the event of his arrest/surrender before the court below within a period of four weeks, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Jehanabad, in connection with Jehanabad P.S. Case No. 81/2019, subject to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
