The petitioner is in custody in connection with Nautan P.S. Case No. 197 of 2020, for the offence under Sections 25(1b)a, 26 and 35 of the Arms Act and Sections 30 and 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He further submits that in the instant case total 57 litres of foreign and country made liquor was recovered with one live cartridge. Petitioner is in custody since 14.06.2020.

Considering the fact that the petitioner has got no criminal antecedent and he has remained in custody for more than eight months, the Court is inclined to grant bail to him. The

No.159 of 2021(2) dt.20-02-2021 2/2 petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Sri Pawan Kumar Pandey, Special Judge, Excise, Bettiah, West Champaran in connection with Nautan P.S. Case No.197 of 2020.
