JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The accusation against the petitioner is that the petitioner was working as consumer helper of the State Bank and he withdrew Rs. 25,000 from the account of one Dukhani Devi from another branch of S.B.I and when the Bank officials started making an inquiry, he handed over the said amount to the aforesaid Dukhani Devi and taken receipt thereof from her. The first information report reflects that the aforesaid amount was withdrawn on 8.10.2013 and the amount in question was returned to Dukhani Devi when the concerned Bank started enquiry.

No.21099 of 2015 (2) dt.03-07-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to grant privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Jehanabad P.S.Case No. 97 of 2015, pending in the court of Chief Judicial Magistrate, Jehanabad stands rejected.

However, this order shall not cause any prejudice to the lower court at the time of consideration of regular bail of the petitioenr.
