JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code. The name of petitioner came in this case on the basis of information given by spy of the police and after that petitioner was summoned for interrogation by the police and confessed his guilt. It appears that except the aforesaid material, there is nothing against the petitioner, who is languishing in jail custody since 04.07.2016 but up till now, he has not been put on Test Identification Parade.
Patna High Court Cr.Misc. No.36936 of 2016 (2) dt.01-09-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Piprakothi P.S. Case No. 82 of 2016.
