2. The petitioner is in custody since 12.05.2016 in connection with Masaurhi P.S. Case No. 290 of 2015 for the offences alleged under Section 307 read with Section 34 of the Indian Penal Code and Section 27A of the Arms Act.

3. It is submitted that the petitioner has been falsely implicated and in any event, the co-accused Sumant Kumar is said to be the main assailant who opened fire causing injury to the informant. Similarly situated co-accused Prabhu Yadav has been granted bail by this Court in Cr. Misc. No. 30947 of 2016.

4. Having regard to the entirety of the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Masaurhi in connection with Masaurhi P.S. Case No. 290 of 2015 with the following conditions:

(i) That one of the bailors shall be a close relative of the petitioner.
