JUSTICE SANJAY PRIYA ORAL ORDER 13-04-2017 Heard learned counsel for the petitioners and the State. The petitioner seeks bail in Nautan P.S. Case No. 17 of 2017 instituted for the offence under Sections-272, 273, 308 of the Indian Penal Code and Sections-30, 38 of the Bihar Excise (Amendment) Act, 2016.
It has been submitted that the petitioner is in custody since 07-02-2017. The petitioner has no criminal antecedent. From the written report and seizure list, it appears that 8 litres 640 mls. Illegal foreign liquor and nine litres country-made liquor has been recovered from possession of the petitioner. Keeping in view that the petitioner has no criminal antecedent and also taking note of the period spent by the petitioner in custody, this petition for bail is allowed and the

No.14756 of 2017 (2) dt.13-04-2017 2/2 petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Nautan P.S. Case No. 17 of 2017 to the satisfaction of learned Additional Chief Judicial Magistrate-XII, Siwan subject to condition that both the bailors should be close relatives of the petitioner.
