The petitioner seeks bail in connection with Kuchaikot P.S. Case No. 58 of 2016 registered under Sections 25(1-B)(a), 26 and 35 of the Arms Act.

It is submitted by the learned counsel for the petitioner that the petitioner has become the victim of highhandedness of police. As a matter of fact, no incriminating article has been recovered from his possession. It is also submitted that the petitioner has got no criminal antecedent and he is in custody since 2nd April, 2016.

Learned counsel for the State has opposed the application for grant of bail to the petitioner.

No.35329 of 2016 (2) dt.22-08-2016 2/2 Regard being had to the period undergone in custody as also the fact that on completion of investigation the police have already submitted charge-sheet, the petitioner Dipu Kumar Soni is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Kuchaikot P.S. Case No. 58 of 2016.
