Petitioner is an accused in a case registered for offence under Sections 147, 148, 149, 323, 324, 307, 379, 504, 506 and 302 of the Indian penal Code.

It is submitted by the learned counsel for the petitioner that it is a case of false implication as there is previous land dispute between the parties for which there is a case and counter case. He submits that there is no witness against the petitioner. From the investigation, it appears that the allegation of assault by sword on the head of the deceased is corroborated by the postmortem report. Other eye witnesses have also supported the allegation against the petitioner.

Patna High Court Cr.Misc. No.23349 of 2018 (3) dt.23-05-2018 2/2 Considering the gravity of the allegation, this Court is not inclined to grant bail to the petitioner for the present. The prayer for bail of the petitioner is rejected. (Madhuresh Prasad, J) N.H./- U T
