JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-08-2019 Petitioners seek bail in anticipation of their arrest in connection with Muffasil P.S. Case No. 21 of 2019, registered for the offences punishable under Sections 341, 323, 325, 354 (B), 379, 504/34 of the Indian Penal Code.
Allegation against the petitioners as per the written report is that seven accused persons including petitioners started abusing the informant and co-accused Hira Ravidas and Sudama Ravidas pulled her sari. Further allegation is that accused persons assaulted her and her husband.
Submission of the learned counsel for the petitioners that allegation of outrage the modesty of the informant is against co-accused Hira Ravidas and Sudama Ravidas and apart from
Patna High Court CR. MISC. No.38181 of 2019(3) dt.29-08-2019 2/2 that there is general and omnibus allegation and there was enmity between the parties. It has also submitted that similarly situated co-accused Shailesh Das @ Shailesh Rabidas, Mukesh Kumar and Kundan Kumar have been granted anticipatory bail by a co-ordinate Bench of this Court passed in Criminal Miscellaneous No. 51943 of 2019 vide order dated 21.08.2019. Heard learned A.P.P. also.
In view of the above facts and circumstances, let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Muffasil P.S. Case No. 21 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
