JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 14-02-2022 Heard both the parties through video conferencing. The petitioner seeks bail in anticipation of his arrest in connection with Gaighat P.S. Case No.31/2021 instituted for the offences under Sections 272, 273, 420, 467, 468, 471, 120(B) of the Indian Penal Code & Sections 30(a)/36/41(1) of Bihar Prohibition and Excise Act, 2018.

Learned counsel for the petitioner submits that the petitioner is the owner of the car which was found at the sight and recovery was made from the car.

Considering the provision of Section 30(2)(iii) of Excise Act, I do not find a case for grant of anticipatory bail.
