The petitioner seeks bail in connection with Jamhore P.S. Case No.24/16 registered under Section 304(B)/34 of the Indian Penal Code.
The accusation is of killing of niece of the informant by pressing her neck by her husband and in laws. Learned counsel for the petitioner submits that admittedly the petitioner is the husband of the deceased. On the day of the occurrence neither petitioner nor his father was present at the house. The deceased wife of the petitioner due to advance pregnancy became ill but she could not be taken to the doctor due to absence of male member in the family and she died. But with
Patna High Court Cr.Misc. No.11241 of 2017 (3) dt.12-04-2017 2/2 ulterior motive the uncle of the deceased lodged the present case. Further submission is that post mortem report shows about pregnancy of 81⁄2 months of deceased and doctor could not identify the ligature mark of the neck. Further submission is that the petitioner is in custody since 19.07.2016 and the charge sheet has already been submitted.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-IIIrd, Aurangabad, in connection with Sessions Tr.No.622/16/275/16 arising out of Jamhore P.S.Case No.24/16.
