2. The petitioner seeks bail in connection with Chandi P.S. Case No. 72 of 2025 instituted for the offences under Sections 103(2), 61, 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. Prosecution case, in short, is that the accused persons including the petitioner committed the murder of informant's brother.

4. Learned counsel for the petitioner submitted that the

Patna High Court CR. MISC. No.37595 of 2025(3) dt.19-08-2025 2/3 petitioner is innocent has falsely been implicated in the present case. The name of the petitioner transpired in this case on the basis of suspicion. Learned counsel for the petitioner submits that general and omnibus allegation has been made against the petitioner. There is no eye-witness to the alleged occurrence. Learned counsel further submitted that the deceased was last seen with one Birju Yadav. The name of the petitioner is being dragged only merely because he happens to be the brother of Birju Yadav. It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.02.2025 and has one criminal antecedent.

5. Learned A.P.P. for the State and learned counsel for the informant vehemently opposed the prayer for grant of bail to the petitioner. Learned APP further submitted that this petitioner has himself confessed his guilt and has narrated the manner in which the accused persons including him committed the murder of the deceased which is further corroborated by the postmortem report of the deceased.

6. Considering the aforesaid facts and circumstances of the case as also there being ample material against the petitioner to show his involvement in the commission of murder of the deceased, this Court is not inclined to grant bail to the

Patna High Court CR. MISC. No.37595 of 2025(3) dt.19-08-2025 3/3 petitioner at this stage.

7. Accordingly, the prayer for grant of bail to the petitioner is, hereby, rejected.
