JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 7 of the E.C. Act. It is alleged that 27 bags of wheat and 18 bags of rice under different subsidy schemes loaded on pick-up van were intercepted when the driver of the pick-up van Sulesh Rai disclosed that the grains were loaded from the PDS shop of co accused Dilip Kumar Yadav and the same was purchased by the petitioner.

It is submitted by the learned counsel for the petitioner that petitioner is neither PDS dealer nor dealer of grains. The recovery has not been made from the petitioner. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve

Patna High Court Cr.Misc. No.20977 of 2015 (2) dt.08-05-2015 2/2 weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Saran at Chapra in connection with Doriganj P.S. Case No. 106 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
