JUSTICE BIRENDRA KUMAR ORAL ORDER 20-06-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 326/307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner is full brother of the informant.

Allegation is that petitioner and co-accused Rakesh Ram fired at the informant causing injury at his stomach.

Submission is that the doctor has found single fire-arm injury and the attribution is not only against the petitioner. The petitioner is in custody since 07.12.2016. He has got no criminal antecedent and for land dispute between the two brothers the false allegation is there.

No.21424 of 2017 (3) dt.20-06-2017 2/2 Considering the fact that single fire-arm injury is not attributed specifically against any of the named accused as well as considering the period of custody of the petitioner, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of Mr. Deepak Kumar learned Additional Chief Judicial Magistrate, Barh, Patna/Successor Court, in connection with Mokama P.S. Case No.14 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
