Petitioner, already in custody, seeks bail in connection with Rajeev Nagar PS Case No.235 of 2017 registered under Sections 399, 402 and 412 of the Indian Penal Code as well as under Sections 25(1-B)a/26/35 of the Arms Act. Allegation in brief is that on secret information, police raided a place and apprehended some miscreants. It is alleged that one country made pistol with two live cartridges were recovered from possession of the petitioner including Rs.13,000/- cash.

Learned counsel for the petitioner submits that recovery of arms is false and the petitioner has no criminal

Patna High Court Cr.Misc. No.11011 of 2018(6) dt.19-06-2018 2/2 antecedent moreover the petitioner is in custody since 05.09.2017 and investigation of the case has already been completed earlier.

Having considered the aforesaid facts and circumstances, petitioner Pankaj Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Patna in connection with Rajeev Nagar PS Case No.235 of 2017.
